2. Let the defect(s), if any, be removed within a period of four weeks from today.

3. This application is filed for grant of regular bail in connection with Pandarak P.S. Case No. 14/2023 registered under Section 392 of the Indian Penal Code.

4. The prosecution story in short is that Hywa vehicle was looted from the driver by three persons on gun point. F.I.R. was lodged against unknown.

5. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case due to politics. He further submits that the name of the petitioner surfaced on

Patna High Court CR. MISC. No.37260 of 2023(2) dt.21-07-2023 2/2 the basis of confessional statement of the co-accused persons which has not evidentiary value. The petitioner has no criminal antecedent. The petitioner is in custody since 31.01.2023. Similarly situated co-accused persons Rajesh Kumar and Ravi Ranjan have already been granted bail by this Court in Cr. Misc 40720 of 2023 and Cr. Misc. No. 35346 of 2023 respectively.

6. Learned A.P.P. has vehemently opposed the prayer for bail.

7. In view of the above, this application for regular bail is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-1, Barh, Patna in connection with Pandarak P.S. Case No. 14/2023.

9. The petitioner will visit Pandarak police station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
