The petitioner is seeking regular bail in his second attempt in connection with Benipatti P.S. Case No. 14 of 2019 registered for the offences punishable under Section 376(A)(B) of the Indian Penal Code and 3⁄4 of the POCSO Act. Earlier the prayer for regular bail of the petitioner has been rejected vide order dated 27.11.2019 in Cri. Misc. No. 59637 of 2019.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the trial is not progressing well and the petitioner is in custody since 16.01.2019. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

No.35500 of 2020(3) dt.30-01-2021 2/2 Having regard to the facts and circumstances of the case, wherein this Court has already rejected the prayer for regular bail of the petitioner on earlier occasion and in fact the learned trial court had reported that 7 witnesses have already been examined in course of trial and the case is fixed for further evidence, this Court is not inclined to grant privilege of regular bail to the petitioner. The prayer for regular bail of the petitioner is, thus, refused.
Let the trial be concluded within a reasonable period. It is expected that the learned trial court shall not fix longer date in the matter and the prosecution shall cooperate in course of trial by producing witnesses on the date fixed in the matter.
