2. The petitioner seeks regular bail in connection with Vijaipur P.S. Case No. 265 of 2021, lodged on 03.12.2021 under Sections 147, 148, 149, 341, 323, 324, 326, 307 and 302 of the I.P.C.

3. Learned Counsel for the petitioner submits that the bail application was earlier rejected vide order dated 19.04.2024 passed in Cr. Misc. No. 4705 of 2024. Counsels submits that the petitioner is not assailant and there is no any specific allegation against him.

4. Learned Counsel for the State opposes the prayer for bail.

5. Upon perusal of the FIR, it transpires to this Court

Patna High Court CR. MISC. No.47582 of 2024(4) dt.04-10-2024 2/2 that the co-accused Jitendra Paswan, who has been granted bail has more criminal antecedent than the present petitioner and he is also the order giver, but allegation against the present petitioner is that he caught the deceased while stabbing was made by the co-accused Prem Kharwar.

6. In this view of the matter, this Court is not inclined to grant bail to the petitioner. Therefore, the bail application of the petitioner is hereby rejected.
