In both the aforesaid bail petitions, petitioners are in
Patna High Court Cr.Misc. No.52058 of 2015 (2) dt.01-12-2015 2/2 custody in Rampur Chauram P.S. Case No. 35 of 2015 registered for the offence under Sections 386, 387 of the Indian Penal Code, Sections 25(1-B)A, 26, 35 of the Arms Act, 1959 and Sections 13, 17, 20 & 40 of U.A.P. Act and as such, both the petitions were heard together and are being disposed of by this common order. At the very outset, it was submitted by learned senior counsel for petitioner(s) that in this case, one of the co-accused has been granted bail by this Court on 17-09-2015, vide Cr.Misc. No. 42737 of 2015.
Learned Addl. Public Prosecutor has opposed the prayer of bail.
However, keeping in view the nature of accusation and period of custody, let the petitioner of both the cases namely Santoshi Chaudhary and Akshay Kumar @ Raju be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Arwal/concerned court in connection with Rampur Chauram P.S. Case No. 35 of 2015.
