Petitioners apprehends his arrest in Excise Case No.63 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The excise official raided the house of the petitioner, Anil Choudhary and recovered 5 bottles of Royal Stag containing 3 litres Indian made foreign liquor from the house of the petitioner.

Taking into consideration the fact that Indian made foreign liquor is recovered from the house of the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.

No.34852 of 2019(3) dt.17-08-2019 2/2 If the petitioner surrenders in the court below, the learned court below shall consider the prayer for bail of the petitioner taking into consideration the fact that small quantity of liquor was recovered and dispose of the bail petition of the petitioner preferably on the same day.
