JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-08-2019 Heard learned counsel for the petitioner, learned Additional Public Prosecutor and perused the case diary. Petitioner is in custody in connection with Sessions Trial No.73 of 2019 arising out of Murliganj P.S.Case No.267 of 2018 pending in the Court of Additional District Judge-III, Madhepura registered for an offence under sections 302, 323 and 504 of the Indian Penal Code.

As per FIR, on 30.07.2018 at about 7 P.M., this petitioner came and started abusing the informant and his father for partition of land and when the same was protested, this petitioner caught hold of his father Rangel Yadav and threw him on the ground as a result of which the deceased Rangel Yadav succumbed on the spot.

Accordingly, the prayer for bail of the petitioner is rejected. However, if the trial of this petitioner is not concluded within six months from today, the petitioner may renew his prayer for bail.
