JUSTICE PARTHA SARTHY ORAL ORDER 10-03-2022 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner has preferred this application for grant of regular bail in a case registered under sections 304B and 34 of the Indian Penal Code.

As per the prosecution case, the accused persons including the petitioner herein are stated to have assaulted and killed the sister of the informant.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. She happens to be the mother-in-law of the deceased. She is a teacher in a government school and is in custody since 5.6.2021. Chargesheet has been submitted in the case. The petitioner has

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner who happens to be the mother-in-law of the deceased having remained in custody for more than 9 months and not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Fatehpur P.S. Case no. 8 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj.
