The petitioner seeks bail in connection with Motipur C"II 67 of 2015 registered under Section 47(a) and 47(f) of the Excise Act.

It has been contended that there is no truth behind the allegation made in the prosecution report. There is no recovery from conscious possession of the petitioner and the petitioner is in custody since 22.09.2015.

Regard being had to the nature of the offence and the period undergone in custody, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate,
