JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 26-07-2023 The present petition has been filed to renew the prayer for grant of bail to the petitioner which was earlier rejected vide order dated 07.02.2023 passed in Cr. Misc. No. 50950 of 2022.

It is alleged by the informant that petitioner committed rape upon the informant. She has also corroborated this fact in her 164 Cr.P.C statement that this petitioner had forcefully committed rape upon her. It appears that vide order dated 21.06.2023, a report with regard to the stage of the trial was called for from the Court below. The report of learned Additional Sessions Judge, 1st, Darbhanga dated 24.06.2023

Patna High Court CR. MISC. No.37126 of 2023(3) dt.26-07-2023 2/2 suggests that out of five prosecution witnesses, four witnesses have been examined and only the Investigation Officer of this case is left to be examined. The trial is also likely to be concluded within three months.

In that view of the matter, the petition is disposed off with a direction to the learned Court below to conclude the trial within a stipulated period of time as mentioned in its report dated 24.06.2023.

The petitioner will be at liberty to renew his prayer for bail, if the trial is not concluded within a period of three months.
