This is a petition for grant of regular bail in a case under Sections 395 and 397 of the Indian Penal Code. This is a petition for bail in a case of misuse of privilege of bail. The petitioner was earlier granted bail but the bail bond of the petitioner was cancelled vide order dated 22.11.2011 as petitioner only attended the court till 06.08.2009. Learned counsel for the petitioner submits that the petitioner has been arrested on 12.09.2015 and undertakes to appear before the trial Court regularly.
Hence, having regard to the facts and circumstances of the case, the petitioner above named is ordered to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, Barh, Patna in connection
Patna High Court Cr.Misc. No.51656 of 2015 (2) dt.10-11-2015 with S. T. No. 105A/05/30/15 arising out of Mokama Rail (Hathidah OP) P.S. Case No. 19 of 2004, Patna, subject to the condition that the petitioner shall appear in the case on each and every date fixed by the court below and any absence of the petitioner shall be subject to the satisfaction of the court below on reasonable grounds.
