This application has been filed on behalf of the petitioner for quashing the order dated 08.01.2021 passed by learned Judicial Magistrate, 1st Class, Gopalganj in Complaint Case No. 2991 of 2019 / Tr. No. 1902 of 2021. The prosecution story in brief in that one Niru Devi filed a complaint petition before the learned CJM, Gopalganj on 18.12.2019 stating therein that her marriage was solemnized on 20.06.2014 with the petitioner and thereafter she came to her matrimonial home. It is alleged that for want of cash of Rs. 20

No.36946 of 2022(3) dt.10-05-2023 2/2 lac as dowry the complainant was subjected to various sorts of torture and cruelty and it went to the extent that finally on 15.10.2019, the accused persons assaulted the complainant badly and lastly ousted her from her matrimonial house retaining her all belongings and therefore the instant case was lodged.

The petitioner is not paying the maintenance amount as has been decided by the Court below and upon reading the complaint, no ground for interference is made out. Accordingly, this application is dismissed.

The trial Court is directed to expedite the trial and conclude the same within three months upon receipt/communication of a copy of this order and file a report in this Court.
