The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 143 of the Railway Act.
The prosecution case is that one Pappu Kumar Paswan was apprehended in front of the reservation counter of Araria Court Rail Station, from whom four tickets of different destinations were recovered, who admitted that he used to get reservation done at the behest of the petitioner being his employer.
It is submitted by the learned counsel for the petitioner that there is no recovery from the possession of the petitioner nor there is any document on record to suggest that the petitioner
Patna High Court Cr.Misc. No.6086 of 2016 (2) dt.08-02-2016 deputed the apprehended accused Pappu Kumar Paswan for getting reservation in the name of different persons. Though the petitioner claims to be a registered travelling agent. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the thrust of accusation against Pappu Kumar Paswan, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Katihar in connection with RPF/Post/Purnea Case No. 585 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
