JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-09-2019 This is an application for grant of anticipatory bail in connection with Kadirganj P. S. Case No. 02 of 2019, disclosing offences under Sections 302, 201, 120B and 34 of IPC. Allegation against the petitioners, who happens to be the mother-in-law, brother-in-law (Devar) and wife of the brother-in-law that they were torturing the deceased with respect to demand and on the day of occurrence assaulting her and forcibly gave her Salphas tablets, due to that she has died and her body was cremated.

Submission of the learned counsel for the petitioners is that no specific allegation has been attributed against them. As a matter of fact, she died due to snake bite and the same was

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of Shri B. N. Tripathi, learned Judicial Magistrate, 1st Class, Masaurhi, in connection with Kadirganj P. S. Case No. 02 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
