2. The petitioner apprehends his arrest in a case registered for the offence under Sections 341, 323, 379, 385, 307, 324, 308, 504, 506, 34 of the Indian Penal Code.
3. As per the prosecution case, petitioner made telephonic call and demanded money of Rs. 5 lakhs, as rangdari. It is further alleged that the petitioner gave knife blow on the head of the informant, causing injury.
4. It is submitted on behalf of petitioner that as a matter of fact the informant and some unknown persons came at the shop of the petitioner and demand extortion of Rs. 3 lakhs and when he made protest, the informant assaulted him and tried to kill him and looted Rs.45,000/- from the counter of the shop
Patna High Court CR. MISC. No.37250 of 2023(3) dt.28-08-2023 2/2 for which the grand-father of petitioner has lodged an F.I.R. being Kotwa P.S. Case No.109 of 2023 against the informant and others. There is case and counter case between both the parties and only with a view to create a defense, the informant has filed this false case. Doctor has found the injury to be simple in nature. Petitioner has got clean antecedent.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 10th Motihari, East Champaran, in connection with Kotwa P.S. Case No. 108 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
