JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-05-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 353, 399, 402 of the Indian Penal Code and Section 30(a)/37(b)(c)/38(ii) of the Bihar Excise Act, 2016. Petitioner was arrested along with others when he as well as others had assembled to make preparation for committing dacoity. Allegedly, one country-made loaded Katta and two live cartridges were recovered from conscious possession of the petitioner. Petitioner does not have any criminal antecedent and is languishing in jail custody since 11.02.2019.

S. Case No. 10 of 2019.
