The petitioner seeks bail in connection with Mohania P.S. Case No. 185 of 2020, registered under Section 392 of the Indian Penal Code.

The accusation is that on 14.06.2020, in the late evening, while informant Jairam Singh was in the way boarding on Apache motorcycle, which was without registration number then a swift car came near him and they overpowered him and took his motorcycle along with cash of Rs. 17,000/- and gold ornaments.

Learned counsel appearing for the petitioner submits that petitioner is not named in the F.I.R. In Course of investigation, one Sunil Kumar was apprehended, who

Patna High Court CR. MISC. No.33818 of 2020(3) dt.11-01-2021 2/2 confessed his guilt and he also disclosed that the theft motorcycle is at the house of petitioner. Thereafter motorcycle was recovered from the house of petitioner. Further submission is that, in fact, the petitioner purchased the alleged motorcycle, which is said to be stolen motorcycle of the present case, from Sunil Kumar. Further submission is that while petitioner is accused in Dinara P.S. Case No. 404 of 2018 registered under Sections 147, 148, 149, 323, 324 and 307/34 of the I.P.C., but he is on bail in that case. The petitioner, in the present case, is in custody since 07.07.2020. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Mohania P.S. Case No. 185 of 2020. One of the sureties must be parents/close relative of the petitioner.
