The petitioner has filed this civil miscellaneous petition against the order, dated 30.05.2016, passed by the learned Principal Judge, Family Court, East Champaran at Motihari, in Matrimonial (Divorce) Case No. 250 of 2014 by which the learned Principal Judge recalled the order fixing the matrimonial suit for ex parte hearing.

Now, the wife has already appeared. In view of this fact I do not find any jurisdictional error in the order, impugned. Accordingly, this civil miscellaneous petition is dismissed with direction to the wife-respondent to appear within one month in Matrimonial (Divorce) Case No. 250 of 2014 before the learned Principal Judge, Family Court, East Champaran at Motihari, and the learned Principal Judge shall dispose off the suit as soon as possible, preferably within six months.
