JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-04-2021 As prayed for, let the learned counsel for the petitioner remove the defect(s), as pointed out by the office vide it's note, dated 14.12.2020, within four weeks of starting of the Court proceeding in physical mode properly.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the state.

The petitioner seeks pre-arrest bail in connection with Nararikala Khurd P.S. Case No. 17 of 2020, registered under Sections 379, 406, 430 and 120B of the Indian Penal Code. The accusation is that there was contract in between NPGC and M/s Grasim Industry to supply 300 metric tons of caustic soda worth Rs.1,28,00,000/-, accordingly, 200 metric tons caustic soda was supplied to NPGC. A tanker, bearing registration no. NL-01Q-6800, which was driven by Ali Hussain (petitioner), reached at NPGC to unload the caustic soda, then, it was detected that the tanker contains three parts connected to each other and on verification the loaded caustic soda was found

Submission is that the petitioner is the driver of the tanker, belonging to one Bishun Kumar Singh, and the same was engaged by M/s Grasim Industry for transporting the caustic soda and the petitioner has no concern about supplying the low quality of caustic soda. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Nararikala Khurd P.S. Case No. 17 of 2020 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
