JUSTICE AJAY KUMAR TRIPATHI) Date: 18-03-2017 Similar matter had already travelled earlier to the High Court before a Division Bench in C.W.J.C. No. 17204 of 2015. The Division Bench agreed with the decision as well as the declaration of law made in O.A. 838/2012, passed on 1st of January, 2015.

In similar terms, the present impugned order has been passed by the Tribunal in OA 644/2014. The date of order is 18.02.2016.

The rationale and reasoning provided by the earlier Division Bench in C.W.J.C. No. 17204 of 2015 also applies to the present case.
