03-12-2015 Heard Sri Umesh Chandra Verma, learned counsel for the petitioner and Sri Madan Kumar, learned Addl. Public Prosecutors.

The petitioner, who is in custody in Shikarpur P.S. Case No. 356 of 2015 registered for the offence under Section 392 of the Indian Penal Code, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that as per the F.I.R., the petitioner was one of the witness and after withdrawing huge amount from the Bank, he was returning alongwith informant. In the meanwhile, some accused persons on motorcycle intercepted and they forcibly snatched entire money, however; subsequently the petitioner has been made accused. He further submits that even before the court below repeatedly time

Patna High Court Cr.Misc. No.52268 of 2015 (2) dt.03-12-2015 2/2 was granted for producing case diary, but the prosecution failed to produce case diary. The learned Sessions Judge, in absence of case dairy and without any material on record, has rejected the prayer for bail.

In view of the facts and circumstances, particularly; the fact that as per the F.I.R., the petitioner was one of the companion and he was also looted by the robbers, there is no reason to detain the petitioner.

Let the petitioner namely Shashi Bhushan Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah/concerned court in connection with Shikarpur P.S. Case No. 356 of 2015.
