Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner has preferred this application for grant of regular bail in connection with Forbesganj P.S. Case No. 243 of 2023 dated 21.03.2023 registered for the offences punishable u/ss 394 and 412 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, two miscreants boarded on a motorcycle came at the shop of the informant and demanded cash from the informant. When the informant

Patna High Court CR. MISC. No.37101 of 2023(2) dt.07-07-2023 2/3 protested then one of the miscreants inflicted blow of dagger in his abdomen but the same hit in his elbow of left arm. Another miscreant demanded entire money of shop from the informant's brother but due to fear, he gave Rs. 41,000/- to the miscreants. Thereafter, the miscreants fled away from the place of occurrence. The informant and his brother brought to the hospital for treatment.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The name of the petitioner has sprung up in this case in the confessional statement of the co-accused Vishal Kumar Mandal. Nothing has been recovered from the possession of the petitioner. The petitioner is accused in two other criminal cases as stated in para 3 of the bail petition. The petitioner is in custody since 22.03.2023.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court
