The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code. As per the prosecution case, petitioner along with others entered the house of informant and petitioner assaulted on her forehead by means of Dabia and took away her gold Mangalsutra and gold earrings.

It is submitted that due to land dispute between the parties the said occurrence took place. The doctor has found injury to be simple in nature caused by hard and blunt substance. Petitioner claims clean antecedent.

No.36904 of 2022(2) dt.07-11-2022 2/2 Considering the backdrop in which scuffle took place, nature of injury and clean antecedent, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Sheohar in connection with Tarriyani Chapra P.S. Case No. 110 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
