JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-02-2016 Petitioners being parents of the husband of the victim are apprehending their arrest in a case registered for the offences punishable under Sections 304B, 201/34 of the Indian Penal Code.
The prosecution case is of killing the daughter of the informant after three years of marriage for non-fulfilment of dowry demand and disposing of the dead body. It is submitted by learned counsel for the petitioners that accusation is omnibus and general against the entire in-laws family including the petitioners and the thrust of accusation is against the husband of the victim who is in custody. The petitioners claim to have been separate from the husband of the victim.
Considering the fact that thrust of accusation is against the husband of the victim, let the petitioners, above
Patna High Court Cr.Misc. No.7298 of 2016 (2) dt.18-02-2016 2/2 named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Buxar in connection with Dhansoin P.S. Case No. 81 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
