JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-04-2021 As prayed for, let the learned counsel appearing for the petitioners remove the defect(s), as pointed out by the office vide its notes dated 14.12.2020, within four weeks of starting of Court proceeding in physical mode in normal course. Heard learned counsel for the petitioners and the learned A.P.P. for the State.

Patna High Court CR. MISC. No.34873 of 2020(2) dt.05-04-2021 2/3 The petitioners apprehend their arrest in connection with Minapur P.S. Case no. 158 of 2020, registered under Sections 147, 148, 149, 452, 323, 354, 354(B), 504, 379 and 380 of the Indian Penal Code.

The accusation is that on 11.10.2019 at about 9.00 P.M., the complainant/informant Tetri Devi along with her daughter was at her house, at that time, nine persons named in the F.I.R. including the petitioners reached there and started to abuse. On the order of Ram Shobhit Singh (petitioner No.4), Bikki Singh @ Vikash Kumar @ Vicky Singh (Petitioner No.1) and Billu Singh @ Shailendra Kumar (Petitioner No.2) carried her from house, Pappu Singh and Amit Singh carried her daughter Manisha, aged about 16 years, and torn her clothes, when complainant/informant and her daughter raised alarm then Vinod Singh (petitioner No.5), Manoj Singh (petitioner No.6) and Vikram Singh (petitioner No.7) caused assault through fist, slaps and Fatha. At that time, Vikram Singh (petitioner No.7) snatched gold chain of informant/complainant and Pappu Singh took cash of Rs. 10,000/- and clothes worth of Rs. 10,000/- kept in attache and they also gave threatening to informant/complainant for dire consequences in case of nonfiling of compromise in the case.

No.34873 of 2020(2) dt.05-04-2021 3/3 Learned counsel for the petitioners submits that petitioners and informant/complainant are pattidar and next door neighbours and due to family dispute, the informant lodged the present case with false allegation. Further submission is that, in fact, earlier the informant had also lodged false case only to put undue pressure due to land dispute. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Minapur P.S. Case No. 158 of 2020, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
