The petitioners are languishing in custody in a case registered for the offences punishable under Sections 341, 323, 504, 120(B), 366(A)/34 of the Indian Penal Code.

It is alleged by the informant that all the F.I.R named accused persons including the petitioners have kidnapped the minor daughter of the informant. It is submitted by learned counsel for the

Patna High Court CR. MISC. No.37361 of 2023(4) dt.10-10-2023 2/3 petitioners that petitioners are innocent and they have falsely been implicated in this case. The son of petitioner No. 2 namely Rahul Kumar Tanti and the victim were in love with each other and they fled away and since petitioner No. 1 is nephew and petitioner No. 2 is father of co-accused Rahul Kumar Tanti, they have been implicated in this case. For the alleged occurrence of 15.02.2023, the F.I.R was registered on 22.02.2023. Moreover, neither the informant nor his wife is the eye witness to the occurrence. The petitioners are languishing in custody since 18.03.2023. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.

In contra, learned counsel appearing on behalf of the informant and learned A.P.P for the State have vehemently opposed the prayer for bail of the petitioner and submitted that victim is still traceless. In pursuance to the direction of this Court, the report with regard to the present stage of the trial has

Considering the facts aforesaid and the period under custody and the fact that trial is not likely to be concluded in near future, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Benipur, Darbhanga in connection with Bahera P.S. Case No. 93 of 2023 (G.R. No. 67/2023).
