Petitioner is named in the first information report with accusation that he along with three others assaulted the deceased with Kulhari and garasa but in course of investigation when further statement of the informant as well as statements of other witnesses were recorded, they stated that this petitioner and one co-accused Lakhan Sharma assaulted the deceased.

Learned counsel for the petitioner submits that co-accused Lakhan Sharma has already been granted privilege of bail by a coordinate bench of this court vide order dated 30.6.2015 passed in Cr. Misc. no.18073/2015.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that there is land dispute between the parties, let the petitioner be released on bail

Patna High Court Cr.Misc. No.29993 of 2015 (3) dt.27-10-2015 on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge VIII, Begusarai in Sessions trial no. 92/2015 arising out of Birpur P.S. Case no. 110/2014.
