ANJANA MISHRA ORAL ORDER 13-05-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Bahera P.S. Case No.272 of 2015 for allegedly having committed the offence under Sections 341, 323, 324, 307, 504 and 379 of the Indian Penal Code.
Case diary in the present case was called for, which has since been received.
Learned counsel for the petitioner submits that though it is alleged that the petitioner had attacked the informant with dagger, no such injury was found on her person. On the contrary, injury report indicates that the injury had been caused by hard and blunt substance and not by dagger.

In view of the aforementioned facts and circumstances and that the petitioner has clean antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Benipur, District-Darbhanga, in connection with Bahera P.S. Case No.272 of 2015/G.R. No.269 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
