2. Petitioner seeks regular bail in connection with Gopalpur P.S. Case No. 219 of 2021 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3 . As per prosecution case, 90 litres of illicit foreign liquor was recovered from the pick-up van .

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case merely on the basis of suspicion . Petitioner is neither owner nor driver of the seized vehicle . Nothing was recovered from the conscious possession of the petitioner and petitioner is in

Patna High Court CR. MISC. No.35189 of 2025(2) dt.18-07-2025 2/2 custody since 18.03.2025 .

5 . Learned A.P.P. for the State vehemently opposes the bail application .

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exlcusive special Judge I , Bhagalpur in connection with Gopalpur P.S.
