2. The present writ petition has been filed for the following relief(s) :
(i) For issuance of an order, direction or writ including writ in the nature of Mandamus commanding the respondent number 3, the Collector, District-Gaya to pass an speaking order in House Control Appeal no. 54 of 2023 filed by the petitioner under The Bihar Building (Lease, Rent& Eviction Control) Act, 1982 against order of the Sub Divisional officer Sadar Gaya pending before it since 18.12.2023.
(ii) For the issuance of a declaration that the
Patna High Court CWJC No.9575 of 2025(2) dt.21-11-2025 2/3 petitioner is entitled to get his appeal decided in terms of and in manner provided under Section 24 of the Bihar Building (Lease, Rent, And Eviction) Control Act, 1982.
(iii) For any other relief(s) to which the petitioner may be found entitled in the facts and circumstances of the present case.
3. Without going into the merits or demerits of this case, the present Writ Petition is disposed of at the stage of admission with the consent of all the counsels.
4. Learned counsel appearing on behalf of the petitioner submits that the only prayer sought for by the petitioner is for disposal of the appeal bearing House Control Appeal No. 54 of 2023 pending before the Respondent No. 3 herein. Counsel submits that the authority has not passed any order even though the Appeal has been filed in the year 2023 and prays for a direction to the Respondent No. 3 to the dispose of the said appeal pending before him by fixing a time frame.
5. Having regard to the above mentioned submissions, the present Writ Petition is disposed of directing the Respondent No. 3 to dispose of the House Control Appeal No. 54 of 2023 as expeditiously as possible, preferably within a period of three months from the date of receipt of a copy of this order. It is
Patna High Court CWJC No.9575 of 2025(2) dt.21-11-2025 3/3 needless to observe that before passing any orders, the petitioner and other interested party shall be put on notice and given an opportunity of hearing.
Any orders passed shall be communicated to the petitioner.
6. With the above directions, the Writ Petition stands disposed of.
