The petitioners are apprehending their arrest in connection with Amas P.S.Case No.28 of 2017 dated 5.2.2017 corresponding to G.R.No.236 of 2017, registered for offences punishable under Sections 18, 20, 22 N.D.P.S. Act.

Allegation against the petitioners as per FIR is that opium plants were found in the field of various persons including the petitioner.

Submission of the learned counsel for the petitioners is that in the FIR there is no mentioning of the seizure of the flower of the opium but later on it has been manipulated in the investigation. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant

Patna High Court Cr.Misc. No.61523 of 2017 (5) dt.18-05-2018 2/2 anticipatory bail to the petitioner rather let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on its own merit.
