JUSTICE RAKESH KUMAR ORAL ORDER 08-12-2015 Heard Sri Ajit Kumar Singh, learned counsel for the petitioner and Sri Ganesh Prasad Singh, learned Addl. Public Prosecutor.

The petitioner, who is in custody since 07.07.2015 in connection with G.R. No.4167/2012(SOS), Kadwa ( Balia Belon) P.S. Case no.315/2012 registered for the offence under Sections 399, 402 of the Indian Penal Code and Sections 25(1-B)A, 26, 35 of the Arms Act and Sections 4,5,6 of the N.D.P.S. Act, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that on the spot, about four accused were apprehended and among them, three apprehended accused have already been granted bail by this Court. He submits that in this case, some arms were shown

Patna High Court Cr.Misc. No.52587 of 2015 (2) dt.08-12-2015 2/2 recovered. Besides arms, 50 Gms of Ganja was also recovered and it was alleged that accused persons had assembled to commit dacoity.

Keeping in view the fact that co-accused persons, namely, Raj Kumar Singh, Gunadhar Singh and Abdul Jilani have been granted bail on 12.03.2013 passed vide Cr.Misc.No.6555 of 2013 and Md. Ansar has been granted bail on 10.07.2013 vide Cr.Misc.No.15558 of 2013, there is no reason to detain the petitioner behind the bar. Let the petitioner, namely, Pawan Singh be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 1st -cum- Special Judge, Katihar in G.R. No.4167/2012 (SOS), Kadwa (Balia Belon) P.S. Case no.315/2012.
