The petitioner seeks bail in Simultala P. S. Case No. 3 of 2019 instituted for the offence under Section(s) 307, 341 and 436 of the Indian Penal Code.

Learned counsel for petitioner submits that instant case has been filed by informant merely on suspicion. In the written report it is alleged that petitioner made demand from the informant of toddy. The informant refused to supply the toddy whereupon petitioner told that he would set his hut on fire. Thereafter the informant went for sleep and in the meantime his hut was set on fire. The informant after coming to know about the same tried to see outside but did not find anybody. The informant sustained burn injury. The injury report

Patna High Court CR. MISC. No.37186 of 2019(2) dt.24-06-2019 2/2 of the injured has been annexed as Annexure-3, wherein, the doctor has found simple injury on the person of the injured caused by burn.

From the written report itself it appears that mere suspicion has been raised against this petitioner by the informant.

Petitioner is in custody since 8.3.2019 having no criminal antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM ,Jamui in connection with Simultala P. S. Case No. 3 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
