JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 20, 21 and 22 of the NDPS Act.
The prosecution case is that one Rohit Ram was apprehended from whom 6 Kg. of ganja was recovered who suggested the name of the petitioner as the person who handed over the same to carry.
It is submitted by learned counsel for the petitioner that admittedly the recovery is not made from the petitioner, hence no case under Sections 20, 21 and 22 of the NDPS Act is made. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named
Patna High Court Cr.Misc. No.53037 of 2015 (2) dt.23-11-2015 2/2 petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge, Kishanganj in connection with Kishanganj P.S. Case No. 245 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
