1. The present petition has been filed for restoration of a writ petition bearing CWJC No.14807 of 2023, which has stood dismissed on account of non-prosecution, by an order dated 30.04.2024.

2. The learned counsel for the petitioner has submitted that on account of inadvertence, the learned counsel for the petitioner could not mark the case in the daily cause list and

Patna High Court MJC No.1759 of 2024(2) dt.05-07-2024 2/2 moreover, the message regarding listing of the said case on the aforesaid date for admission, was also not received by the learned counsel for the petitioner, resulting in him not being able to appear before this Court, when the aforesaid writ petition was called out for hearing, leading to the aforesaid writ petition being dismissed on account of non-prosecution, thus, a sympathetic view be taken and the aforesaid writ petition petition be restored to its original file.

3. Having regard to the submission made by the learned counsel for the petitioner as also considering the averments made in the present petition, I deem it fit and proper to restore the aforesaid writ petition bearing CWJC No.14807 of 2023 to its original file.
