JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-03-2021 The present petition has been filed seeking transfer of Guardian Case No. 07 of 2018 (Suresh Kumar Prasad vs. Srimati Mala Prasad & Ors.) from the Ld. court of Principal Judge, Family Court, Samastipur to the Ld. court of Principal Judge, Family Court, Darbhanga.

The learned counsel for the opposite parties has appeared and has submitted that though he has no objection to transfer of the case, but a time frame may be fixed for disposal of the aforesaid Guardian Case No. 07 of 2018 and

Patna High Court MJC No.2035 of 2019(4) dt.01-03-2021 2/3 further, he seeks liberty to approach the learned court below for grant of visitation rights.

Having regard to the consensus arrived at between the parties, I deem it fit and proper to transfer the aforesaid Guardian Case No. 07 of 2018 (Suresh Kumar Prasad vs. Srimati Mala Prasad & Ors.) from the Ld. court of Principal Judge, Family Court, Samastipur to the Ld. court of Principal Judge, Family Court, Darbhanga. The record of the said Guardian Case No. 07 of 2018 (Suresh Kumar Prasad vs. Srimati Mala Prasad & Ors.) be transmitted by the Ld. court of Principal Judge, Family Court, Samastipur to the Ld. court of Principal Judge, Family Court, Darbhanga forthwith. It is needless to state that the learned court of Principal Judge, Family Court, Darbhanga shall make all endeavours to dispose of the aforesaid Guardian Case No. 07 of 2018 within a period of one year from the receipt of the records of the aforesaid case from the Ld. court of Principal Judge, Family Court, Samastipur.

The present petition stands disposed of on
