The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and 47(a) of the Excise Act. From the truck of the petitioner 1320 litres spirit were recovered when the driver escaped from the scene. It is submitted by learned counsel for the petitioner that the petitioner is the owner of a public carrier and he was not aware about the spirit being transported by the driver. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

No.6118 of 2016 (2) dt.08-02-2016 2/2 The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Muffasil P.S. Case No. 304 of 2015 pending in the court of learned Additional Chief Judicial Magistrate-VI, Motihari, East Champaran.
With the aforesaid observation, this application is disposed of.
