The petitioner seeks bail in anticipation of his arrest in Dhamdaha P. S. Case No.37 of 2020 dated 23.02.2020 registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.

This is the third attempt of the petitioner to seek bail as earlier his bail application was rejected, as petitioner being husband has been implicated in a case under Section 304-B of the I.P.C.

The learned counsel for the petitioner submits that the charges have been framed and trial has commenced. The Court is not inclined to release the petitioner on bail and accordingly, prayer for bail of the petitioner stands

Patna High Court CR. MISC. No.39276 of 2023(2) dt.05-07-2023 2/2 rejected.

However, the learned trial Court is directed to expedite the trial. In the event, if the trial is not concluded within a period of nine months from the date of receipt/production of a copy of this order for no fault of the petitioner, then in that event, the petitioner would be entitled to renew his prayer for bail.
