JUSTICE RAKESH KUMAR ORAL ORDER 30-11-2015 Heard Sri Parash Nath, learned counsel for the petitioner and Dr. M.K. Gautam, learned A.P.P. The petitioner, who is a lady and is in custody since 11.6.2015 in connection with Sasaram (Model) P.S. Case No. 599 of 2015 , registered for the offence punishable under Section 395 and 412 of the Indian Penal Code, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that F.I.R. was lodged against six unknown male accused persons regarding committing dacoity in a private firm namely, Magma Fincorp Ltd. In the said occurrence about Rs. 48 Lakhs and odd was looted on gun point. It has been submitted by learned counsel for the petitioner that only on an allegation of recovery of Rs. 50,000/- from the petitioner, the petitioner has been made accused

Patna High Court Cr.Misc. No.52034 of 2015 (2) dt.30-11-2015 2/2 and is languishing in jail. It has been argued that recovered money has no connection with the looted cash. He further submits that however other accused persons whose name have come in the confession, have already been granted bail by this court. The F.I.R. was lodged against unknown.

Learned A.P.P. has opposed the prayer of bail. Keeping in view the fact that in the F.I.R. there was specific accusation that six male accused persons had committed crime and there was no mentioning about involvement of lady accused, only on an allegation of recovery of Rs. 50,000/-, at least the petitioner may not be allowed to be further detained. Accordingly, let the petitioner namely Sarita Devi @ Savita Devi @ Muskan Kumari @ Muskan be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (Model) P.S.
