The petitioner apprehends his arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code. Later on, section 411 was added. FIR was lodged against unknown for theft of the motorcycle of informant.

It is submitted that complicity of the petitioner surfaced during course of investigation on the basis of confessional statement of co-accused Mahavir Kumar Sah who was apprehended with stolen motorcycle. No incriminating article has been recovered from conscious possession of this petitioner.

Considering the facts aforesaid, the petitioner above-

Patna High Court CR. MISC. No.36907 of 2022(2) dt.07-11-2022 2/2 named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sikrahana at Dhaka, East Champaran in connection with Dhaka P.S.
