In this case, the petitioner is seeking regular bail in connection with S.T. No. 354 of 2022 arising out of K.Hat P.S. Case No. 759 of 2019, registered for the offences punishable under Sections 363, 366 of the IPC.

As per allegation, the petitioner is accused of kidnapping of wife of the informant, who is mother of four children.

The learned counsel for the petitioner has submitted that the entire allegation is false. The alleged victim as well as her husband (informant) were examined during course of trial of co-accused. They did not support the prosecution case and they

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge Purnea in connection with S.T. No. 354 of 2022 arising out of K.Hat P.S. Case No. 759 of 2019, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, his bail bond shall be liable to be cancelled.
