The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 354/34 of the Indian Penal Code and 3(1)(x) of SC/ST (Prevention of Atrocities) Act.

The prosecution case is that the accused persons including the petitioner abused and manhandled the informant, who is Block Pramukh.

It is submitted by learned counsel for the petitioner that the petitioner village road was being constructed on the land of the petitioner for which protest was made, hence, the case has been lodged. It is further submitted that no injury

Patna High Court Cr.Misc. No.6244 of 2016 (2) dt.09-02-2016 2/2 was caused to the informant. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the nature of accusation, it is a case of consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Hussainganj P.S. Case No. 84 of 2015 pending in the court of learned Chief Judicial Magistrate, Siwan. It is expected from the learned court below to dispose of the bail application of the petitioner preferably on the same day.

With the aforesaid observation, this application is disposed of.
