Petitioners are in custody in connection with Aurai P.S.Case No.77 of 2019 registered for an offence under Sections 302, 341, 323, 147, 148 and 354 of the Indian Penal Code. It is alleged in the FIR that all the accused persons came to the shop of the informant and asked his mother to vacate the land, on which co-accused Amarnath Thakur caught hold of neck of mother of the informant and assaulted with lathi and danda and she became unconscious and subsequently she died.

No.37370 of 2019(3) dt.04-09-2019 2/2 It is submitted on behalf of the petitioners that the petitioners have falsely been implicated in the present case due to existing land dispute. It is also submitted that both the petitioners are ladies. He further submits that chargesheet has already been submitted, having no criminal antecedent and petitioners are in custody since 24.03.2019. He further submits that similarly situated co-accused persons have already been granted bail by coordinate Benches of this Court in Cr.Misc.No.34397 of 2019 and Cr.Misc.No.34334 of 2019. Considering the aforesaid facts and circumstances, let the above named two petitioners be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-cum-Sub Judge-14, Muzaffarpur in connection with Aurai P.S.Case No.77 of 2019.
