This is an application for grant of anticipatory bail in connection with Mushrigharari P.S. Case No. 38 of 2016, disclosing offences under Sections 341, 342, 307, 34 of IPC and Section 27 of the Arms Act.

Allegation as per F.I.R. is that son of the informant was surrounded by the petitioner and other accused persons and one co-accused asked his son to call one Md. Rasool and trying to take him, on that, his son raised hulla and thereafter, the accused fired on him.

Submission of the learned counsel for the petitioner is that he is only named in the F.I.R.. Nothing has been attributed against him.

Patna High Court CR. MISC. No.33974 of 2019(3) dt.02-08-2019 2/2 Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that case is of the year 2016 and he named in the F.I.R. and now after three years, he has come for grant of anticipatory bail.

Having heard both sides, in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner may move before the learned court below for regular bail which will be considered by the learned court below and if possible, be disposed of on the same day.
