JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-01-2021 The learned counsel for the petitioner has submitted that the balance amount of Rs. 6,50,000/- on the head of gratuity has been paid during the pendency of the present writ petition, however, the interest on the delayed payment of the outstanding amount of gratuity has not been paid, which has to be specifically paid in terms of Section 7(3-A) of the Payment of Gratuity Act, 1972 as also in terms of the judgment rendered by the Hon'ble Apex Court in the case of D.D. Tiwari (dead) through Legal Representatives vs. Uttar Haryana Bijli Vitran Nigam Ltd. & Ors., reported in (2014) 8 SCC 894. Having regard to the facts and circumstances of the
Patna High Court CWJC No.11188 of 2018(6) dt.13-01-2021 2/2 present case and considering the law laid down by the Hon'ble Apex Court in the case of D.D. Tiwari (supra), the respondents are directed to forthwith calculate and pay interest on the delayed payment of gratuity within a period of six weeks from today.
The writ petition stands disposed of with the aforesaid directions.
