JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-02-2016 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code.
The prosecution case is of abducting the minor daughter of the informant. It is alleged against the petitioners that these petitioners enticed away the victim on the pretext of easing out when co-accused Rakesh Kumar took her on motorcycle and subsequently by train to Dhanbad who wanted to marry the victim.
It is submitted by learned counsel for the petitioners that actually the abduction was made by Rakesh Kumar and the petitioners being maternal aunts of co-accused Rakesh Kumar have been roped in the present case.
Patna High Court Cr.Misc. No.6951 of 2016 (2) dt.16-02-2016 2/2 The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioners surrender within a period of six weeks in connection with Durgawati P.S. Case No. 260 of 2015, pending in the Court of learned Chief Judicial Magistrate, Kaimur at Bhabhua. It is expected from the Court below to dispose of the regular bail of the petitioner, preferably on the same day.
With the observations above, the application stands disposed off.
