30-11-2015 Heard Sri Sunil Kumar - III, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner, who is in custody in Ghora Sahan P.S. Case No. 56 of 2014 registered for the offence under Section 307 & other allied sections of the Indian Penal Code, has prayed for grant of bail.

Learned counsel for the petitioner submits that against the petitioner, there is general and omnibus allegation. He submits that co-accused namely Vijay Kumar Yadav, against whom there was specific accusation that he poured acid on the informant, whereby she received injuries, has already been granted bail by this Court on 08-09-2015, vide Cr. Misc. No. 12239 of 2015, primarily on the ground that the prosecution had failed to produce nature of injuries sustained by the injured. He further submits that

Patna High Court Cr.Misc. No.51901 of 2015 (2) dt.30-11-2015 2/2 one another accused person namely Rambishwash Rai has also been granted bail on 23-12-2014, vide Cr. Misc. No. 29544 of 2014. The petitioner is in custody since 27-06-2015. Keeping in view the fact that other co-accused persons, having serous accusation than the petitioner, have already been granted bail, there is no reason to deny the prayer of bail of petitioner.

Let the petitioner namely Ajay Kumar Yadav be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Sikrahana at Dhaka, East Champaran/concerned court in connection with Ghora Sahan Case No. 56 of 2014.
