The petitioners, being the driver and cleaner of the truck in question, are languishing in custody since 16.04.2019 in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise (Amendment) Act, 2018. It is alleged that from a truck, 432 litres of Indian Made Foreign Liquor were recovered.

It is submitted by learned counsel for the petitioners that the owner of the truck was also travelling in the truck and thrust of accusation is against the owner of the truck in question. A statement has been made in paragraph 3 of the petition that

Learned APP submits that the Considering the statement being made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent, let the above named petitioners be released on provisional bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 3887 of 2019, arising out of Pandarak P.S. Case No. 44 of 2019, on filing affidavit to the effect that they will co-operate during investigation. The provisional bail of the petitioners will be confirmed by the learned Court below on conclusion of the investigation on further being satisfied that petitioner has cooperated during investigation.
