The petitioner apprehends his arrest in Excise Case No.138 of 2020 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The complainant alleged that he got secret information and on such, a raid was conducted in the flour mill of the petitioner. 38.88 litres of liquor was recovered. Learned counsel for the petitioner submits that the liquor was recovered for near the flour mill of the petitioner, which is an open place. Anybody can keep liquor in an open place but from the seizure list, it appears that the liquor was recovered from inside the house and from near the flour mill of the petitioner.

Patna High Court CR. MISC. No.35010 of 2020(2) dt.18-03-2021 2/2 Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
