Patna High Court MJC No.1101 of 2020(3) dt.03-03-2021 2/2 appearing for the petitioner, Shri Yogesh Chandra Verma, seeks to withdraw the present petition, however, with liberty to challenge the consequential action of lodging of a criminal case as well as initiation of a departmental proceeding against the petitioner, in light of the observation made by a co- ordinate Bench of this Court vide order dated 22.08.2017 passed in CWJC No. 17550 of 2012 regarding the order dated 4.4.2013 passed in the said case having lost its effect. Accordingly, the present petition stands disposed of as not pressed, however, with liberty to the petitioner herein to challenge the criminal proceeding as well as the departmental proceeding, initiated against him, in accordance with law.
