====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 23-06-2025 Heard Learned Counsel for the petitioner and Learned Counsel for the Canara Bank.

2. Learned Counsel for the petitioner submits that the present writ petition has been filed with the following reliefs:- (i) Respondents-Canara Bank be directed to reinstate the petitioner on the post of Law Officer scale 2, cancelling resignation.

(ii) Respondents-Canara Bank be directed to issue that the petitioner has been on

Patna High Court CWJC No.9486 of 2025(2) dt.23-06-2025 2/3 leave on loss of pay- continuity of service from 01.11.2017 to disposal of writ petition.

3. During argument, counsel for the petitioner submits that the petitioner has earlier moved before this Hon'ble Court in C.W.J.C. No.17713 of 2022 in which vide order dated 23.04.2024, the writ petition was disposed off with observations which states as follows:-

2. After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to approach the respondent-authorities for redressal of his aforesaid grievances. Liberty, so sought is granted.

3. The writ petition stands dismissed as not pressed.

4. Counsel further submits that with the observations passed by this Hon'ble Court in the above mentioned writ application, the petitioner has moved before the authority concerned and the said authority has passed order on his representation vide Annexure-P/5 of the writ petition. He further submits that by the said decision of the Assistant General Manager, request for reinstatement of the services of the petitioner has been rejected. Thereafter, the petitioner has moved before this Hon'ble Court, but the said order has not been challenged.

5. Counsel for the Bank submits that in the Banking Organization, there is a channel made in which the order of Assistant General Manager is appealable order.

6. In this background, counsel for the petitioner seeks permission to withdraw the present writ petition with liberty to challenge the order passed by the General Manager before the Appellate Authority.

7. In the light of the submissions made, the present writ petition stands dismissed as withdrawn with liberty to the petitioner to file an appeal before the appropriate forum within 30 days from today along with this order.

8. With the aforesaid liberty, the present writ application stands dismissed as withdrawn.
